PENAL PROVISIONS...

XVI. PENAL PROVISIONS

Article 132
In the period from November 15 to April 1, all vehicles of categories M and N that participate in traffic during winter conditions (snowfall or when there is snow, ice or ice on the road) must have tires for winter use on all wheels. The minimum depth of the pattern on the tread surface of tires used in the period referred to in paragraph 1 of this article is 4 mm.
Vehicles from paragraph 1 of this article must also meet other requirements regarding winter equipment prescribed by this law. For certain types and categories of vehicles on a certain road or part of the road, at a certain time, the obligation to use tires for winter use can be established regardless of whether there are winter conditions on that road. The time period and the road, i.e. the parts of the road on which the use of tires for winter use is mandatory in the sense of paragraph 4 of this article, are prescribed by the Ministry in an order based on the previously obtained opinion of the state authorities administration responsible for traffic affairs.

Article 315
A fine in the amount of 3,000 to 6,000 euros will be imposed on a legal entity for a misdemeanor, if:
8a) order or allow, in the period from November 15 to April 1, a vehicle of category M or N that does not have tires for winter use on all wheels or that does not meet other conditions regarding winter equipment prescribed by this law, participate in traffic during winter conditions (Article 132 paragraph 1 and 3);

Article 316
A fine in the amount of 1,500 to 4,000 euros will be imposed on a legal person for a misdemeanor, if:
15) order or allow a vehicle whose tire tread depth is less than 4 mm to participate in traffic in the period from November 15 to April 1 (Article 132 paragraph 2);
33) order or allow a vehicle that does not meet the prescribed conditions in terms of dimensions, total mass, axle load or does not have the correct prescribed steering devices, stopping devices, tachograph, tires or does not have a tachograph installed (Article 242);

Article 317
A fine in the amount of 1,500 to 4,000 euros will be imposed on a legal person for a misdemeanor, if:
14) orders or allows his vehicle, during the validity of the order, to participate in traffic without tires for winter use (Article 132 paragraphs 4 and 5);
37) order or allow a vehicle that does not have correct devices and equipment to participate in traffic on the road except for steering devices, stopping devices, tachograph, tires or does not have a tachograph installed (Article 242);

Article 318
A fine in the amount of EUR 500 to EUR 1,000 or a prison sentence of up to 60 days shall be imposed for a misdemeanor:
10) a driver who in the period from November 15 to April 1, during winter conditions, participates in traffic with a vehicle of category M and N that does not have tires for winter use on all wheels or that does not meet other conditions regarding winter equipment prescribed by this law (Article 132 paragraph 1 and 3);

Article 319
A fine in the amount of EUR 300 to EUR 600 will be imposed for the offense:
21) a driver who participates in road traffic with a vehicle that does not meet the prescribed conditions in terms of dimensions, total mass, axle load or does not have the correct prescribed steering devices, stopping devices, tachograph, tires or does not have a tachograph installed (Article 242);

Article 320
A fine in the amount of EUR 200 to EUR 400 will be imposed for the offense:
26) a driver who, in the period from November 15 to April 1, participates in traffic with a vehicle whose tread depth is less than 4 mm (Article 132 paragraph 2);

Article 322
A fine in the amount of EUR 150 to EUR 300 will be imposed for the offense:
30) a driver who, during the validity of the order, participates in traffic without tires for winter use that meet the requirement regarding the minimum tread depth (Article 132 paragraph 4 and 5);
37) a driver who participates in road traffic with a vehicle that does not have proper devices and equipment except steering devices, stopping devices, tachograph and tires (Article 242);
